Regarding Updates to the Terms of Service Due to the Addition of the AI Assistant Feature
Terms updated for the new AI Assistant (Gemini). Data is sent only when used (not for training; limited logs). Output rights belong to the input image’s rights holder.

We released the new AI Assistant feature at around 2:00 PM on September 4, 2025. Along with this release, we have updated parts of our Terms of Service and added new provisions. Please see the summary below.
Key Points of the Terms of Service Update
- Updates related to the AI Assistant feature
Since the AI Assistant uses external APIs, we have incorporated the external service’s prohibited/restricted-use policies into copainter’s Terms of Service. - Data is sent outside of copainter only when using the AI Assistant
Data is transmitted outside of copainter only when you use the AI Assistant. Because we use the API provider’s Paid Services, the transmitted data will not be used for training or improving the provider’s models. Limited logging may occur for the purpose of monitoring misuse. - Rights to images generated via the AI Assistant
The rights to images generated using the AI Assistant belong to the rights holder of the input image.
Additions to Existing copainter Terms of Service
■ Additions to Article 2 (Definitions)
- AI Assistant: A generative AI feature provided within this Service, which operates using Google’s generative AI services (including the Gemini API / Gemini 2.5 Flash).
- Google: Google LLC and its affiliates.
■ Addition to Article 10 (Prohibited Conduct)
- Any act related to the AI Assistant that violates Google’s prohibited/restricted policies for generative AI, or attempts to bypass safety features.
■ Additions to Article 14 (Handling of Personal Information, etc.)
- We may provide transmission data, etc. to Google, or have it processed on servers located outside Japan, to the extent necessary to provide the AI Assistant.
- We provide the AI Assistant only via Paid Services and do not use Unpaid Services (e.g., free tiers or direct use of AI Studio). In this case, prompts and responses are not used to improve Google products, though they may be logged for a limited period solely for policy-violation detection.
- Handling of personal information—such as third-party provision, cross-border transfer, and other processing—related to the AI Assistant will additionally follow our Privacy Policy.
■ Addition to Article 23 (Surviving Provisions)
- Article 26, Paragraphs 4–8 and Paragraph 10 shall remain in effect after termination of the service agreement.
Newly Added Article 26 (AI Assistant Special Terms (Gemini Integration))
1. Definition
In this Article, “this feature” means the “AI Assistant” feature provided within this Service, which operates using Google’s generative AI services (including the Gemini API / Gemini 2.5 Flash).
2. Scope and Priority
These special terms apply only when a registered user uses the AI Assistant. If these terms conflict with the main Terms of Service, these special terms shall prevail to the extent of such conflict (i.e., they constitute “individual provisions” under Article 1, Paragraph 3).
3. Provision Method
We provide this feature only via Paid Services and do not use Unpaid Services (e.g., free tiers or direct use of AI Studio). We also do not use Grounding with Google Search.
4. Age and Region
Users must be 18 years or older to use this feature. In accordance with Google’s availability and requirements, we provide the feature in regions such as the EEA, Switzerland, and the UK only to the extent the Paid Services requirements are satisfied.
5. Use of Third-Party Services (Transmission, Storage, Cross-Border Transfer)
By using this feature, the registered user agrees that transmitted data (images, text, audio, video, files, etc.) and responses (including AI outputs) may be sent to Google and processed and temporarily stored at Google or its contractors’ facilities, including outside Japan. Under Paid Services, such data is not used to improve Google products, though limited logging may occur to monitor misuse.
6. Safety and Prohibited Conduct
Users must comply with Google’s generative AI policies and must not generate or distribute harmful content or attempt to bypass safety features. Use for medical practice (e.g., diagnosis or treatment) is prohibited.
7. Rights
Google does not claim ownership of content generated through this feature, but users acknowledge that identical or similar content may be generated for others. Intellectual property rights for AI outputs within this Service are governed by Article 13.
8. Attribution
We may display appropriate attribution such as “Powered by Google Gemini” on the feature screen, to the extent reasonably required by Google.
9. Fees and Tickets
If additional costs arise in providing this feature, we may set usage fees and/or ticket consumption amounts and announce them within the Service or on our website.
10. Changes and Suspension
Due to changes in Google’s specifications, pricing, or policies, or for technical/operational reasons, we may change, discontinue, or suspend all or part of this feature (in accordance with Article 12).
11. Non-Applicability to Other Features
The above provisions apply only to this feature and do not apply to other features within this Service. If we use third-party generative AI services for other features in the future, we will establish separate individual provisions.
12. Survival
Paragraphs 5–8 and Paragraph 10 of this Article shall survive even after account cancellation or discontinuation of this feature.
